Chisinau City Hall provides details about case of Capital Constructions Division

The conflict between SRL “Fastcomtrans” and the Chisinau City Hall has lasted for 10 years, the Chisinau administration has said. It confirmed that the introductive application submitted by SRL “Fastcomtrans” concerning the institution of insolvency proceedings against IM “Directia constructii capital” (“Capital Constructions Division”) was accepted by the Chisinau Appeals Court on April 21. The court ordered that the property and bank accounts of the municipal enterprise be sequestrated and appointed a temporary administrator, IPN reports.

In a press release, the Chisinau City Hall says that in 2006 SRL “Fastcomtrans”, which is represented by the Socialist councilor Oleg Onishckenco based on a power of attorney, won a tender contest to repair the façade of the Chisinau lyceum “M. Kotsiubinski”, which is an architectural monument of national importance located on Mihai Eminescu St. The Chisinau City Hall paid a sum of about 100,000 lei for the purpose. The works could not be continued because it was a protected building and a project was needed in this regard. The business entity was asked to draw up the project documentation with the allocated money.

Without taking into account the requests of the Chisinau City Hall, the company continued the repair works on the façade in the absence of a restoration project and with violations of all the building norms. This fact was confirmed by the technical examinations performed in time. The plaster is now falling off the building’s façade, while the executed works do not meet the set criteria.

According to the Chisinau administration, later the business entity filed a lawsuit against the local public administration, claiming 9 million lei based on an expenditure estimate written by it. After a trial that lasted for about 6 years, the Supreme Court of Justice decided that the Chisinau City Hall should pay 3.7 million lei to the company. The local authorities described the company’s acts as swindle that blocked the work of a municipal subdivision. Recently, SC “Fastcomtrans” SRL signed a contract to transfer the debt to another company that was founded by Oleg Semeniuc. This is the same Oleg Onishchenco who on January 25, 2016 changed his name into Semeniuc.

By accepting the application to bring insolvency proceedings against the Capital Constructions Division, the Appeals Court seriously affects the work of the municipal company and the public interest as the implementation of over 100 contracts for repairing and making investments in social facilities and water and sewerage networks is in danger. The given enterprise manages 272 km of gas pipes that supply gas to consumers in Chisinau municipality. Thus, the city’s energy security is also in danger. Also, the Division’s employees haven’t been paid salaries for several months.

The City Hall also said that on May 18 the Supreme Court of Justice will examine the application to review the case filed by the local administration following suspicions of falsity in this case.
