Chisinau City Hall powerless against unauthorized constructions
The municipal servants admit they are powerless against people building auxiliary structures without any formal authorization. The district offices can only record the contraventions and report them, but it is the State Construction Inspectorate that is empowered to take such cases to court, Centru District Head Vladimir Sarban has told Info-Prim Neo.
However, few cases reach the court because it is very difficult to determine who exactly broke the law after those unauthorized structures change hands.
Fines are issues in nine in ten cases that reach the court, and after the fine is paid the construction may be authorized.
The municipal police say they cannot forbid unauthorized constructions either. “We can only notify the Construction Inspectorate”, says Chisinau's police chief Silviu Musuc. The Code of Administrative Offenses was amended two years ago so sanctions can be imposed only with the contribution of the Inspectorate.
Chisinau Mayor Dorin Chirtoaca instructed the legal division to collect the necessary information to propose amendments to the Parliament. “If finding unauthorized constructions is the responsibility of the local authorities, then they should also have the levers to fight them”, said the mayor.
