Children's ombudswoman Tamara Plamadeala has sued the Chisinau City Council and City Hall accusing them of limiting the children's right to play and rest. The proceeding is in relation to a playground which the municipality at first authorized but now wants it dismantled. The municipal authorities, for their part, claim that the plot has been occupied illegally and that the ombudswoman has stood up for a business that is violating the law, Info-Prim Neo reports.
Tamara Plamadeala recalled at a Tuesday news conference that the playground was installed in 2008 by a private company in a park in Ciocana district. The area features various playground equipment which the children can use for 40 lei an hour.
The ombudswoman noted that the 6,000 sq.m. playground had been authorized by and selected together with municipality officials. However, according to Tamara Plamadeala, the local authorities have been delaying a City Council procedure that would formally confirm the tenant status of the playground's constructor.
In 2009 the City Hall sued the occupier requesting it to vacate the plot. The case ended up in the Supreme Court, which ruled in the occupier's favor. Now Ombudswoman Plamadeala demands that the City Council comply with the ruling and conclude a formal contract with the playground business, and pay it almost one million lei in damages.
Both the ombudswoman and the playground owner claim the evacuation is sought by some municipal officials with hidden interests, such as to sell the plot so that restaurants or villas could be built there instead.
Mayor Dorin Chirtoaca, for his part, told reporters that the company was allowed to install a playground only for a limited period of time, but now it stakes a claim to it. “It's preposterous to see a plot staked off illegally out of a purely economic reason and, even more, a ombudswoman defend this interest. You give them one finger and they're taking your whole arm”, said the Mayor.
