Certain articles of Electoral Code were improperly modified in 2007-2009, ADEPT
The amendments introduced to the Electoral Code in 2007-2009 did not take into account the recommendations concerning the ensuring of free and fair elections made by the European institutions. Some of them even worsened the situation as they were approved without consulting the OSCE Office for Democratic Institutions and Human Rights (OSCE/ODIHR) and the Venice Commission. The recent modifications proposed by the current administration solve only minor problems. These conclusions are contained in the analytical study “The International Institutions' Recommendations about Moldova's Legislation and Electoral Procedures” made by the Association for Participative Democracy (ADEPT). The study was presented on May 31, Info-Prim Neo reports.
ADEPT law expert Corneliu Gurin said some of the amendments introduced into the Electoral Code in 2007-2009 were improper and this fact was confirmed by international organizations. These include the ban on holding dual nationality imposed on candidates for MP and the members of the Central Election Commission, the ban on forming electoral blocs, preventing of party members from running in elections on the lists of another party. “Some of recommendations were fulfilled, but ad hoc. Thus, in 2008 the Venice Commission and OSCE/ODIHR reiterated practically all the previous recommendations,” Corneliu Gurin said.
Referring to the amendments approved in 2009-2010, after the power was changed, the expert said that 2/3 of the proposals and recommendations were discussed, but there are a number of technical problems that should be addressed in Parliament.
The Deputy Head of the OSCE Mission to Moldova Claus Neukirch said the Electoral Code should be improved before the parliamentary elections. He added that extensive internal discussions on the necessary amendments should be held at internal level.
ADEPT executive director Igor Botan denied the assertions that the modification of the Electoral Code is not opportune. “Those who criticize the present amendments, arguing that they are introduced before the elections are wrong. Last year, the Electoral Code was modified also before elections,” he said.
The experts said the MPs should take account of these recommendations when they pass the amendments to the Electoral Code in second reading.
