President Igor Dodon requested the Constitutional Court to pronounce on the control of the constitutionality of the Law of December 20, 2019 to amend the Law on the Superior Council of Magistracy (SCM) and to say if a majority of votes of MP is needed for choosing the SCM members from among law professors, IPN reports.
The Court was also asked to say if the introduction of the obligation to choose the SCM president only from among judges-members of the Council is constitutional and if the existence of disciplinary punishments during the past three years was a discriminatory condition for applying for the post of Council member.
On December 20, the MPs adopted a bill to amend the SCM after giving it a final reading. Under the amendments, the SCM will be supplemented with two members from among professors who will be chosen by the legal commission and by a member from among judges who will be chosen by the General Assembly of Judges. This way, the number of SCM members will be extended from 12 to 15.
