CC rejects President’s requisition concerning law on SCM

The Constitutional Court (CC) dismissed as inadmissible President Igor Dodon’s requisition to check the constitutionality of the law of December 20, 2019 to amend the law on the Superior Council of Magistracy (SCM), IPN reports.

President Dodon asked the Court to say if a majority vote is needed in Parliament to choose SCM members from among law professors and to determine if the institution of the obligation to elect the SCM president exclusively from among judge members of the Council is constitutional.

He also requested the CC to say if the existence of disciplinary punishment during the past three years is a discriminatory condition imposed on those who intend to apply for the post of SCM member.

On December 20 last year, the MPs gave a final reading to the bill to amend the law on the Superior Council of Magistracy, passing it by 51 votes in favor. Under the provisions, the SCM will be supplemented with two members from among professors who will be chosen by the Parliament’s legal commission for appointments and immunities and by one member from among judges who will be chosen by the General Assembly of Judges. This way, the number of SCM members will be extended from 12 to 15.
