CAPC points to corruptibility risk in draft law on minimum subsistence level
The Center for Analysis and Prevention of Corruption (CAPC) has examined the draft law on the minimum subsistence level in Moldova and traced a corruptibility risk in it, Info-Prim Neo reports.
The legislative initiative was drafted by an MP. The draft law contains the legal basis for fixing the minimum subsistence level in Moldova, which will constitute the basis of state guarantees provided to the Moldovan citizens for obtaining a minimum income and of social protection measures.
According to the CAPC report, the draft law contains stipulations and methods for determining the minimum subsistence level, but there are no concrete relevant norms. The conception of the draft law is not clear because it does not include sufficient norms to insure the coherence of the norms contained in the draft. The draft law could be regarded as a legislative proposal for the Government to examine the situation and work out a bill that would propose a mechanism for determining the minimum subsistence level by correlating the living standards, the minimum salary and the nominative compensations that must be provided to guarantee every person’s right to existence. From this viewpoint, it would be hard to determine the appropriateness of the draft law and, as it would have a declarative and inefficient character, it would not be approved.
CAPC experts said that the informative note to the draft law makes no reference and does not stipulate the costs of implementing the given law. Though the draft law proposes that the minimum subsistence level should be increased gradually, the author of the project does not indicate the financial resources and does not say whether the Government or the economic entities have such resources.
“For the draft law to be examined and approved by the Parliament, it should be clearly formulated and there should be identified the necessary financial resources so that it meets all requirements,” experts of the Center say.
The draft law on the minimum subsistence level in Moldova, which was registered in the Parliament under No. 3042 on 28.10.2008, is to be inspected by the Parliament.
