Candidate for profession of lawyer suggests amending Law on Advocacy

The Law on Advocacy must be reviewed because some of the provisions of this law stimulate corruption, said Dumitru Buliga, who applied to be admitted to the bar. In a news conference at IPN on March 10, the lawyer formulated a number of proposals in this respect, saying he will submit them to the competent parliamentary commission.

Dumitru Buliga noted there are no clear criteria for assessing the candidates and in such conditions it’s not clear why some are accepted, while others are rejected. The illegalities committed by the licensing commission are determined by the human factors and by the imperfect law.

Dumitru Buliga explained that the legislation does not oblige the members of the commission to explain their decision when they reject a candidate for the profession of lawyer. The commission’s decision can be challenged in the administrative courts of law only as regards the examination procedure, not yet the exam result.

“I repeatedly call on all the MPs to take note of this situation and to modify the Law on Advocacy, if they really want the reform in the justice sector to be done and Moldova to become a state with the rule of law, where the basic rights and fundamental freedoms are defended by qualified lawyers,” said Dumitru Buliga.

He also said that a part of those who want to become lawyers, though they have a high professional training level, do not manage to take the exam owing to the corrupt system, which is protected by the law.
