Bill to amend legislation on dwellings includes terms that do not correspond to legal norms

Experts of the Center for the Analysis and Prevention of Corruption (CAPC) warn that the bill to amend the legislation on dwellings, proposed by the Ministry of Regional Development and Construction, includes terms that do not correspond to the existing norms. Also, the author of the bill institutes new powers for mayor, which are not among the powers of the public administration.

In a news conference at IPN, CAPC expert Viorel Parvan said the new powers given to the mayor, such as to consult the population about the exploitation and administration of dwellings and to offer methodological and legal assistance when registering associations of condominium co-owners, are inappropriate for a mayor. Furthermore, these powers are not stipulated in the Law on Dwellings.

Viorel Parvan referred also to other contradictory norms. “For example, particular terms introduced in the Law on Dwellings are formulated one way, while in the Contravention Code these are formulated in a different way,” he stated. According to him, these dissimilarities cannot be accepted because when the Code is implemented and the people have to be penalized, unclear situations, of abuse, will appear as the Code includes a particular text of the norm, while the basic law another text.

A norm that attracted the experts’ attention introduces penalties for dirtiness in apartments and apartment buildings. “This is interference in the ownership right of the people. The norms do not correspond to the Law on Dwellings based on which the bill was drafted,” stated Viorel Parvan.

CAPC head Galina Bostan said another proposed amendment is to penalize the persons who will carry out noisy reconstruction works before 8am and after 6pm. “We have the Law on Dwellings, which lays down the main standards. It is important for the changes made by this draft law to meet these standards,” she stated.

The appraisal was carried out within the project “Harmonization of the legislation with the international human rights standards” that is supported financially by the Civil Rights Defenders of Sweden. The bill is to be examined by Parliament.
