Some provisions of the Bill on the Financing of Political Parties and Election Campaigns contradict national legislation and have political interests. This is the conclusion reached by the Center for Analysis and Prevention of Corruption (CAPC) expert Mariana Calughin, after a corruptibility test on the bill, reports Info-Prim Neo. The author of the bill is First Deputy Speaker Vlad Plahotniuc, MP from the Democratic Party (PDM) fraction. The CAPC expertise report mentions that the bill has provisions that, if applied, may promote individual or group interests at the detriment of public interest. Mariana Calughin says that the parties will promote people who give greater donations, and people who don’t contribute financially are highly unlikely to be appointed to public positions. According to CAPC, there are no specific rules for donations, for avoiding conflict of interests. Additionally, the bill has no rules that would insure, through specific sanctions, that the donations made by legal entities to parties must be registered in their books. Mariana Calughin says their absence is a reason for fiscal evasion or even money laundering. Meanwhile, according to the expert, a great deal of stipulations does not correspond to the respective European standards, especially to the European Council Committee of Ministers’ Recommendation on common regulation against corruption in the financing of political parties and campaigns. Galina Bostan, CAPC president, stated that the bill was expected to clarify the situation with donors, who, during political campaigns, were suspected to be fake; however, the tests show that this will not be the case if the current draft is approved. According to CAPC, the quality of the bill does not justify its adoption as a special Law. However, for the solution of several issues related to political Parties’ and campaigns financing, CAPC would accept amendments to the Code of Administrative Offenses, Election Code, Fiscal Code, Criminal Code, the Law on Political Parties, etc., but only to the extent of providing real improvements. According to bill author Vlad Plahotniuc the goal of the bill at hand is to ensure transparency in political Parties’ and electoral candidates’ financing, and for equality of chances in political competition.
