The Moldovan legal system is not viable because the Moldovan authorities lack enough skill and political will to implement the laws, find experts from the Development and Social Initiatives IDIS „Viitorul” think tank, in a study launched Thursday in Chisinau, Info-Prim Neo reports. Some important laws are published several months later after being adopted. Now there still laws laws containing the term “judet” (county instead of raion (district)) , although from the administrative viewpoint, Moldova's territory came back to the raions in 2002, the study points out. The experts find that the MPs don't take into account the fact that adopting some laws implies changing older ones. The contradictory legal frame, in some cases, and the lack of views, action plans, strategies, programs, to harmonize the laws cause incertitude, block activities and and create even conflict situations, said Viorel Furdui, an IDIS expert. The Parliament also passes laws providing obligations fore the local public administrations without providing the due funds, he said. At the same time, the Government is spared of ministerial responsibility, while the Parliament does not have adequate and efficient control over the Government's implementing the laws, and thus the delay in executing one's duties is encouraged, the study shows. In addition, the two state power branches don't see the need to consult the civil society ans the academic environment in this respect. The authors recommend the authorities to boost the transparency degree in the work of the public institutions in terms of adopting and implementing laws, to pass a law concerning the ministerial responsibility and cooperate closer with the civil society and the scientific domain.
