Authorities fulfilled no Constitutional Court advisory note in 2011

None of the nine advisory notes sent by the Constitutional Court in 2011 was fulfilled by the Government and Parliament, which are responsible for removing the shortcomings identified by the Court and adjusting the normative and legal documents to the supreme law, the Court’s chairman Alexandru Tanase said when presenting a report on the work done last year, Info-Prim Neo reports. The authorities are to examine the notes issued by the Constitutional Court and to inform about the results of the examination within at most three months. “Given that these notes are not fulfilled and no amendments are made, the normative framework remains imperfect and the authorities realize this. Our notes are intended to help the authorities deal with the inevitable drawbacks,” Alexandru Tanase explained. He said that the Court had done a fruitful work in 2011 as the case law was enriched and developed. As many as 39 applications were filed to the Court last year. Another ten applications remained from 2010. Fourteen of the 18 applications submitted to the Court by lawmakers were lodged by Communist MPs. The ombudspersons filed eight applications, the Central Election Commission – seven, the Supreme Court of Justice – two, the minister of justice and the prosecutor general – by two. The applications refer to social protection, the political system, conflicts between the authorities, the independence of the legal system, and the protection of human rights.
