Authorities aim to improve court decision implementation procedure

The Cabinet approved amendments to a number of laws in a move to improve the mechanism for examining civil lawsuits and implementing court decisions, IPN reports.

If Parliament adopts these amendments, the creditors will be able to choose another bailiff even if the court decision implementation order was submitted by the court of law for execution.

The sides involved in the execution procedure will be able to directly challenge in court the documents of the bailiff. Preconditions are being created for disputing the actions and inaction of the bailiff.

On the other hand, the bailiff will be able to ask the court to impose a fine of 200 to 600 lei on persons who file challenges to court for formal reasons or with ill will.

The amendments provide that the litigious rights will be sold by auction and specify the rules of holding the auctions organized by bailiffs to sell the sequestrated goods. At most three auctions will be held and the selling price of the goods cannot fall below 50% of the value at which they were assessed.
