The members of the commission for selecting candidates for the post of Constitutional Court judge on behalf of the Government filed an application to the Cabinet led by Prime Minister Pavel Filip concerning candidate Veaceslav Zaporojan. The signatories ask that Veaceslav Zaporojan, who was chosen by the commission seven months ago, should be appointed as judge or should be rejected with appropriate reasoning, IPN reports.

The application says the delay in naming the Constitutional Court judge by the Government leads to the violation of the principle of supremacy of the Constitution and the obligation for all the people and all the public authorities to obey the law. The delay also jeopardizes the work of the Constitutional Court.

According to the signatories, the commission, by its work, does not undermine the unilateral and constitutional right of the Government to decide the definitive candidate for this post. The proposals submitted to the executive are only recommendations and are based on the results achieved by the candidates who take part in the public contest. Veaceslav Zaporojan had the highest score in the given contest.

The commission members ask that if Veaceslav Zaporojan is rejected, a new contest should be organized in the shortest time possible.

The application was signed by the ex-president and ex-judge of the Constitutional Court Victor Puscas, who is the commission’s deputy chairman, ex- Constitutional Court judge and public law expert Nicolae Osmochescu, head of the Press Council Ludmila Andronic, dean of the Law Faculty of the State University of Moldova Sergiu Baiesu, executive director of the Association for Participatory Democracy Igor Botan, former senior state adviser to the Prime Minister Sergiu Gurduza, who is the commission’s secretary, and Sorina Macrinici, of the Legal Resources Center of Moldova.
