The judges of the Constitutional Court (CC) said they fulfilled and are decided to further fulfill with honor and dignity their constitutional duties. According to them, the whole activity and all the decisions of the Constitutional Court are based exclusively on the norms of the Constitution and any pressure of any kind on the CC judges is unacceptable in a democratic state with the rule of law. The statements made by state officials during the last few days can create a negative public atmosphere around the Constitutional Court and can discredit the constitutional judges, IPN reports, quoting a statement signed by the six CC judges.

The judges note that on July 29, 1994, the people of the Republic of Moldova, realizing their national sovereignty, adopted the Constitution as the supreme law of the state through their representatives. The Constitution provides that no law or any other legal act that runs counter to the Constitution has legal effect. To achieve this desideratum that is fundamental for the rule of law, the lawmakers established the Constitutional Court as the only constitutional jurisdiction authority that, independently from any other public authority, guarantees the supremacy of the Constitution, ensures the realization of the principle of separation of powers in the state and guarantees the responsibility of the state to the citizens and of the citizens to the state.

“We, the signatories, on August 16, 2019, pledged before the whole nation to honestly and consciously fulfill the obligations of judge of the Constitutional Court, to defend the constitutional order of the Republic of Moldova, to obey only the Constitution while fulfilling our duties,” reads the statement.

The constitutional judges call on the MPs, the President of Moldova, the members of the Government, political parties, civil society, media outlets and other opinion shapers to identify, within the limits of the supreme law, the wisest solutions to cope with the crises faced by the Republic of Moldova.
