ANPC to propose new Competition Bill
Viorica Carare, director of the National Agency for Protection of Competition, says that a new law is needed to govern competition, as the current one doesn’t clearly stipulate the conditions of applying penalties, the amount of fines and the conditions for checking companies that break fair competition rules, Info-Prim Neo reports.
“The new law will assure greater transparency in the activity of ANPC workers and of companies. The current legislation rarely specifies unannounced inspections. We haven’t performed such inspections because the Law on competition doesn’t stipulate it”, the ANPC director declared during a press conference on Tuesday.
Bogdan Marius Chiritoiu, head of the Romanian ANPC, said that unannounced inspections were the main tool of checking suspicions of cartel agreements in Romania. “When we have some clues and start an investigation, our people can enter any company and request any document related to the investigation, without a warrant. It’s the main tool of collecting evidence”, he said.
Viorica Carare added that the new Law on competition had to clarify the way of punishing agents infringing the competition principles. The proposal will be debated by national and international experts before being submitted to the Government and to the Parliament. The document was developed as part of a Twinning Project by ANPC and experts from Romania, Austria and Latvia. The EU allotted €1 million for this project.
