Andrei Nastase files application to review election invalidation decision to Supreme Court

Dumitru Pavel, the legal representative of Andrei Nastase, whose election as mayor of Chisinau wasn’t validated, submitted an application to review the decision to invalidate the early mayoral elections held in Chisinau municipality to the Supreme Court of Justice. The application was filed because new circumstances appeared in this electoral case, IPN reports.

Dumitru Pavel issued a press note which says that the application to replace the Druta, Gafton and Burduh panel of judges, was examined with the involvement of a judge who cannot hold the post of judge because this reached the retirement ceiling of 65. However, judge Oprea Iuliana continues to work and examined the replacement application and tried other cases.

According to Dumitru Pavel, this is a reason for reviewing the decision by which the replacement of the three discredited judges was rejected given that this fact became known later. Moreover, this leads to the invalidation of the Supreme Court of Justice’s judgement by which the filed appeal was rejected as inadmissible.

The legal representative of Andrei Nastase notes that in a similar case the Republic of Moldova was convicted by the European Court of Human Rights, the findings stipulated in that decision being applicable to the current case. They thus requested to retry the case and to pass a judgment based on the law, which is to validate the Chisinau early mayoral elections.
