Andrei Năstase about eventual verdict of CC: a President is obliged to look for solutions

The president of the Party “Dignity and Truth Platform” Andrei Năstase said that in a European state, the Constitutional Court would rule in favor of Parliament in the case concerning the ascertaining of circumstances for dissolving the legislative body. President Maia Sandu ignored the solutions presented by the MPs for overcoming the political crisis and this can serve as a reason for keeping the legislature functional, IPN reports.

Andrei Năstase noted the CC’s verdict on the application filed by Maia Sandu concerning the dissolution of Parliament is predictable in a state with authentic democracy. The President rejected the Parliament’s proposals for breaking the political stalemate.

“If this case was discussed in a European state, the verdict would be to go back to Parliament. If this was tried in a civilized world, the Constitutional Court would say that a President is obliged to look for solutions for the country and, as long as a Parliament provides such solutions, they should be accepted. If Parliament does not offer them, snap elections should be called,” Andrei Năstase stated in the talk show “Fourth Power” on N4 channel.

Andrei Năstase noted he banks on the independence of the CC judges and hopes that these are not subject to pressure by politicians or the foreign factor.

“This case is very simple, given the Constitution, the CC decisions and, what’s more important, the reality. This case is so simple than it does not imply much effort. The message we transmitted when we were able to influence the composition of the Court was that legality and independence from the political and foreign factors should be ensured,” stated Andrei Năstase.

After President Sandu went to the Constitutional Court, the Socialists also filed an application to the Court whereby the judges are informed about the inexistence of the circumstances for dissolving Parliament and the existence of a formalized parliamentary majority that proposed a candidate for Prime Minister.
