An order “from above” throws the human rights, the legislation, final decisions of the supreme court into the trash can, said Gennady Bîlba, the owner of the building located at 129 Spartacus St in Chisinau municipality, who was issued with a court decision ordering the demolition of the building. The investor says that he has all the necessary documents – building permit, urban planning certificate, receipt documents and examinations that prove compliance with all the requirements.
In a news conference hosted by IPN, Gennady Bîlba said that when he decided to start that construction, he asked for the consent of the neighbors. As not everyone agreed, he decided to respect the distance from the border, as specialists of the City Hall recommended. When the construction started, a female neighbor of his started to intimidate her, demanding that he should purchase the house of a relative of her at a triple price in exchange for her consent. Mrs. Buga did not give her consent, but he started the construction and this fact upset her a lot. Immediately she started to file complaints to all the courts.
According to him, a series of appeals followed, with all kinds of claims, requests to adjust the building project, including trials in 2018-2022, because the neighbor challenged the permissive documents in court. At the Supreme Court of Justice, the applicant met with refusal. “Further, Mrs. Buga attacked me personally to stop the construction and demolish it. Again many court hearings followed. At the SCJ, her requests were denied,” said the owner of the building.
The construction was erected and put into operation, but the woman, making use of the “connections in the supreme state bodies”, continued with all kinds of petitions. Measurements and examinations were carried out again, demonstrating that no violations were committed in the building process. But, even so, the district head’s office, based on the notification received from the Building Inspectorate, issued a report regarding the demolition of the construction, which Gennady Bîlba contested. But it turned out that the court, in the absence of an examination, ordered the demolition. In the hope of being done justice, he went to the Court of Appeals, which after long delays and in his absence upheld the decision regarding the demolition.
“So, it comes out like this, after an order comes from above, I don’t know from which body, the human rights, the legislation, the court decisions are all thrown into the trash can. The Building Inspectorate, the district head’s office fulfill the order of those from above,” stated Gennady Bîlba.
