Amnesty cannot cover all offenses committed in April
The Government considers that not all the offenses committed by the participants in the April 6-7 events can be pardoned. After examining a legislative initiative to stop the investigation or trying of those persons submitted by a group of MPs, the Ministry of Justice said the amnesty can cover only the offenses connected with the infringement of the right to assembly, right to peaceful protests and right to expression, Info-Prim Neo reports.
“The amnesty cannot apply to three types of offenses defined in articles of the Penal Code, namely article 285 – mass disorder, article 339 – usurpation of the state power, and article 349 – threatening or violence used against a person holding a responsible position. We are against the amnesty of acts of torture, maltreatment, thefts, robberies and other offenses that are not connected with the circumstances of the protests,” said Minister of Justice Alexandru Tanase.
Tanase also said that the amnesty in the mentioned cases should be done with the written contest of the persons involved.
As a result of the April 6 -7 events, there were opened 52 legal cases over hooliganism, 42 over robbery, 12 over mass disorder, 1 over causing of serious bodily injuries, 1 over causing of medium bodily injuries, 3 over torture, 5 over misuse of power, 3 over forging of public documents,1 over threatening of persons holding responsible positions and others.
