The Government approved amendments to the Code of Criminal Procedure. Minister of Justice Vladimir Grosu said the changes are aimed at adjusting the legislation to the provisions of Article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms and the case law of the European Court of Human Rights, IPN reports.
The bill sets an arrest time limit within legal proceedings so as to make sure that the principle of predictability of the legal norm is respected, especially as regards detention during trial. There were included new criteria and motives for determining the necessity of remanding a person in custody, such as public danger.
The arrest will be used only in the case of a culprit or defendant, not yet of a suspect. Also, the prosecutor’s powers to countermand custody when the reasons and necessity of arrest disappear are extended.
