The country’s neutrality is not a constitutional value either in the case of the Republic of Moldova or in the case of other states that have such a provision in the Constitution. This is a clause that works only in conditions of normality. In times of peace, this clause works. But when Moldova has a war close to its borders, an open aggression, this clause no longer work, ex-minister of justice Alexandru Tănase, former president of the Constitutional Court, stated in a roundtable meeting staged by the Agency for Military Science and Memory, IPN reports.
“The Government has the constitutional right to take any action that it considers suitable in this situation, In accordance with the Constitutional Court’s decision of May 2, 2017, the Government is obliged to take all the measures, to form any alliance of any kind to defend the basic values of the Constitution that are actually not neutrality, but independence, sovereignty, the democratic regime, human rights and others,” he stated.
Alexandru Tănase also said that together with the Russo-Ukrainian war, the world has changed and a series of fundamental institutions will be reformed after this war ends. Neither the UN nor OSCE will look as they look today. “That’s why Moldova should be prepared to cope with these changes and to take opportune, intelligent decisions in the interest of the country’s national security, which would enable us to really ensure safe existence for the citizens,” he stated.
Colonel Vitalie Ciobanu said that the country’s administration at the moment tries to assume political responsibility for security and defense by applying different diplomatic methods in the context of its neutrality policy, taking into account economic, financial, social aspects and sometimes ignoring real existential dangers.
“The Republic of Moldova is considered a zone of geopolitical influence and interests, with the Russian Federation permanently having instruments to exert pressure. The conflict in the eastern districts of the Republic of Moldova, the Russian occupation troops, the traditional export market that prevailed until now and the dependence on one energy supply source marked the population’s living standards, the state of spirit in our society,” said the colonel.
According to Minister of Defense Anatolie Nosatyti, the current regional security context influenced by the war entails the adoption of different approaches to the neutrality concept, but these are often erroneous and camouflaged in the form of propagandistic messages.
A permanently neutral power is a sovereign state which is bound by international treaty, or by its own declaration, to be neutral towards the belligerents of all future wars. The concept of neutrality in war is narrowly defined and puts specific constraints on the neutral party in return for the internationally recognized right to remain neutral.
