About 70-80% of the articles of the fundamental law do not need to be amended and should remain intact, the president of the Constitutional Court of Moldova Alexandru Tanase said in the program “Fabrika” on Publika TV channel, IPN reports.

According to Tanase, these articles refer to the basic human rights and freedoms, the main obligations and the country’s independence and territorial integrity. The judge said some of the articles of the Constitution need indeed to be modified and the Presidential Office should initiate this process. “It will be a long and difficult process that will involve a number of forces. But the state structure wanted by the people must be determined,” stated Alexandru Tanase.

Speaking about the Constitutional Court’s decision providing that the language spoken on Moldova’s territory is called Romanian, Tanase said it is an explanatory decision and Parliament is not obliged to start amending Article 13 of the Constitution, but it should take this decision into account. Society is not yet ready for such a change.

The program’s permanent invitee Cristian Tabara also said that society is not prepared for such a modification and that Article 13 was one of the tricks of Russia that it now uses in its own interests.

The president of the Constitutional Court underlined the necessity of reviewing the article stipulating that the prosecutor general is named by Parliament. “A method should be found to exclude political influence on the prosecution service and to ensure the independence of prosecutors. As long as the political class has influence on the prosecution service, the reform will not succeed,” stated Tanase.

He also pleaded against empowering the Constitutional Court to examine complaints of people whose rights were violated in court. “In the future, this will be a good thing, if we have a functional legal system. Now our justice sector is not functional and the Constitutional Court’s activity will be thus blocked,” said the judge.
