A constitutional mistake was made in 2000, which the Constitutional Court corrected by its March 4, 2016 decision, the Court’s president Alexandru Tanase said in the program “In Depth” on PRO TV Chisinau channel, IPN reports.
“The Constitutional Court could intervene after it was asked to pronounce on the issue. I don’t think that this decision can suit someone in particular, but the people who wanted to choose the head of state themselves. I consider there is the necessary number of votes for choosing the head of state in Parliament. The election of the President by Parliament became a dangerous precedent for democracy. We do not have parties with internal democracy. It’s not right for the decisions to be taken in one office,” stated Alexandru Tanase.
He believes the given decision is the most difficult one taken ever by the Constitutional Court. “It is the most difficult decision. The reasoning of the judgmen consists of about 200 paragraphs. Reference was made to the constitutional legislation of the European states,” said the Court’s president.
Alexandru Tanase also said that even if the head of state is chosen by the people, Moldova remains a parliamentary republic. “There is a tendency in Europe as regards the model of parliamentary republic with the President elected by the people. The model that will be followed by Moldova is very close to that of Lithuania,” he stated.
Alexandru Tanase noted he will not run for the presidency of the Republic of Moldova. “I will complete my duties as president of the Constitutional Court,” he said.
