Administrative Code to be applied in Moldova

The legislative body adopted the first Administrative Code of the Republic of Moldova in the final reading on July 19. This defines the way in which the public authorities and institutions should function, IPN reports.

The Code systematizes all the legal regulations concerning the administrative procedure and administrative disputes into one legal act as to ensure clarity, coherence and accessibility. The new rules specify the area where the administrative procedure is applied and the way in which it is applied, the participants in the procedure and its phases, the administrative operations and contracts, implementation of administrative documents, administrative control, appellate procedure, etc.

There will be regulated the issuing of administrative documents by public authorities, the mechanisms for dealing with petitions submitted by citizens and the refusal to accept or examine an application. Also, the public authorities will be obliged to compile an administrative file.

According to the author, the document will clarify the principles, concepts and stages of the administrative procedure, appellate procedure and legal regime of administrative documents, operations and contracts in a move to ensure the respect for the rights and freedoms of private individuals and legal entities based on the public interest and the rule of law principles.

The Administrative Code will come into force on April 1, 2019.
