Approximately 400 persons were released from detention in Moldova before time in 2016. In the Republic of Moldova, parole is possible if the court of law considers the convicts can improve their behavior without serving the full sentence. But the person must fully repair the damage caused by the offense and accept to do remunerated or non-remunerated work to clean and lay out the penitentiary and the area around it while being in detention.
The detainees can ask to be allowed to leave prison before the end of their sentence through the agency of the lawyer or by addressing the administration of the Department of Penitentiary Institutions. The decision is taken by the court of law.
In an answer to an inquiry by IPN New Agency, the Department of Penitentiary Institutions says parole is applied if the detainee served at least half of the sentence given for the commission of minor or less serious offenses. If the detainee committed a serious offense, this should serve at least two thirds of the sentence, while in case of very serious or exceptionally serious offenses at least three fourth of the sentence should have been served. The person sentenced to life can be set free before time if this served at least 30 years in jail, without taking into account the privileged compensation of workdays.
In case of minors, the release on parole is possible if these served at least one third of the sentence given for the commission of minor or less serious offenses, at least half of the sentenced for a serious offense and at least two thirds for a very serious or exceptionally serious offense.
If the person released on parole violates the public order during the period of the sentence that remained non-served and this is fined or if this intentionally avoids fulfilling the conditions imposed by the court of law before parole, the court can annul the parole and send the convict to serve the rest of the sentence in jail.
If these persons return to prison, they must not return the lump-sum paid to them when they are released on parole, but are not entitled to such a payment the second time.
