Judges of the Chisinau Court of Appeals and of the Botanica Court are implementing property dispossession schemes, said jurist Ion Dron. According to him, an example is the dispossession of the carrier “Milos M”, which has been in litigation for five years owing to a false lending receipt for over 4 million lei.

In a news conference at IPN, head of the Center of Public Authorities Monitoring and Initiatives Ion Dron related that in 2009, a person sued the given company, arguing that a loan wasn’t repaid to him. He presented in a court a contract and receipts showing that a loan was provided. After the first court ruled in favor of the given person, the company’s director appealed the decision to the Chisinau Court of Appeals, which yet upheld the decision of the Botanica Court.

Ion Dron said the carrier presented an assessment report produced by experts of the Ministry of the Interior, the National Anticorruption Center and the Examination Center of the Ministry of Justice, showing that the lending document was false as a text with the borrowed sum was written on papers with the company’s stamps and signature.

“The judges were obliged to thwart this attempt to appropriate property given the presented evidence. But they considered that the expert appraisal didn’t have a legal value because the carrier didn’t prove that the person who presented the false document had the company’s stamps and signature,” said the jurist. According to him, the husband of a woman judge, who is providing transportation services, is behind this scheme.

The financial director of SRL “Milos M” Ion Popescu said that though the claimed debt is of 4 million lei, the first court ordered sequestrating property owned by the company whose value is 2-3 times higher than this sum. There were sequestrated all the firm’s 12 vehicles and its building.

Entrepreneur Mihail Milos told the same news conference that he started his business in 2000 and invested millions of lei in purchasing buses. He didn’t have business relations with the person who is trying to dispossess him of property, but the two know each other.

The jurists of SRL “Milos M” appealed the Court of Appeals’ decision to the Supreme Court of Justice. In this connection, they called on the Ministry of Justice to really reform the judicial system, not to present only strategies and reports on paper.
