A company alleges it could be dispossessed of a 500 thousand euros building

The representatives of a Slovenian company, "A5 Plus Nepremicnicne Poslovanje D.O.O.", contend that they could be deprived of a building in the center of Chisinau, worth 500 thousand euros. A year and a half after the transaction, the company was notified that, in a trial initiated by a former owner of the building, Chisinau Court cancelled the purchase contract, and the building was seized.

At an IPN press conference, Marisa Kurilo, director of "A5 Plus Nepremicnicne Poslovanje D.O.O.", said that the company was operating in the area of investments in real estate market.

Lawyer Ion Crețu recalls how the building was purchased by the Slovenian company. In July 2016, he was contacted to provide legal assistance at the conclusion of the sale-purchase contract of a building on Veronica Micle street. The advertisement concerning the real estate sale was placed on a commercial bank’s website and as a result the Slovenian company submitted the offer. The agreed price constituted 500 thousand euros.

The defense lawyer says he checked the information in the real estate Register and found out that, as of 2011, "Liga 2" company was indebted to "Moldindconbank". On March 1, 2012, "Moldindconbank" as a secured creditor sold the respective building to "Star-Trans-Grup" company. And in 2016, four years later, "Star-Trans-Grup" sold it to "A5 Plus Nepremicnicne Poslovanje D.O.O." company. Subsequently, a contract has been signed between the two companies, with the bank's agreement.

The defense lawyer also said that "A5 Plus Nepremicnicne Poslovanje D.O.O." purchased the building in good faith, and did not know and had no way of knowing about possible disputes regarding the real estate.

Another lawyer, Gregor Klemencic, says that the defense counsellors are waiting for the motivated part of the judgment, after which the next actions will be taken. In his view, a solution would be negotiations between the companies or a trial of this case by an arbitration court in a third state, neither the Republic of Moldova nor Slovenia.

Nicolai Grishkun, co-founder of the company, asked for the opinion of two experts, one from Germany and another from Hungary. The two were of the opinion that in this case the action should have been dismissed upon its filing. The decision made by the Chisinau magistrate shows that either he does not know the law or there is an element of corruption, said Nicolai Grishkun.
