The woman with five children who was sentenced to six years in jail because she failed to repay a loan can be set free based on the law on pardoning on the occasion of the 30th anniversary of the independence of the Republic of Moldova. The head of the pardoning commission Ion Guzun said the case of Natalia Ursachi can fall under this law. For his part, the lawyer for Natalia Ursachi says that his client was wronged and should be released, IPN reports.
The lawyer and the family of Natalia Ursachi yesterday had a meeting with President Maia Sandu, who was asked to review her decision concerning the mother with five children. At the suggestion of the pardoning commission, President Sandu refused to pardon Natalia Ursachi.
“We asked to examine our pardoning request again, given the favorable appraisal issued by the Rusca Penitentiary. We met with the Ursachi family and with Minister of Justice Sergiu Litvinenco and asked the minister to order an inquiry into the way in which the criminal case against Natalia Ursachi was started. Under the law, no one can be jailed based on civil relations, for the simple reason that a person is unable to repay the debts assumed by contract. Natalia Ursachi’s actions didn’t contain elements of the offense of which she was convicted,” Iuian Rusanovschi stated in the program “Freedom” on TV8 channel.
For his part, Vitalie Plugari, who is the victim in this case, said that he offered a car to Natalia Ursachi and had waited for over five years for the women to pay him the money for the car.
“She proposed buying the car based on proxy so that she could use this to take out a loan from a bank. In a month, she told me that the bank refused to lend money to her. I waited rather long for her to pay at least a part of the money,” stated Vitalie Plugari.
Parliament is to examine a bill on pardoning on the occasion of the 30th anniversary of the independence of the Republic of Moldova. The head of the pardoning commission said Natalia Ursachi can be released from prison based on this law.
“About 280 women, a part of who have three or more children, are held in Moldova’s jails. We took into account the fact that she has five children, but we cannot ignore other systemic aspects, like the caused damage. There is a bill on pardoning on the occasion of the 30th anniversary of the independence of the Republic of Moldova and this covers mothers with three and more children. Missis Ursachi can fall under this bill,” stated Ion Guzun.
Natalia Ursachi was initially sentenced to eight years in jail for not repaying a loan of €8,000, but the Appeals Court reduced the sentence to six years. The woman raises alone five children who are now in the care of their grandmother.
