In cases of an amicable settlement, photos or videos of the car accident scene must show the general panorama of the impact, license plates and damaged parts of the motor vehicles. Images of braking marks and shards, if any, shall also be provided. The clarification was made by the National Commission for Financial Markets (NCFM), IPN reports.

When photos are taken from the scene of the accident, the position of the damaged vehicles should not be changed. The pictures shall include, where possible, road signs and markings from the scene of the accident.

According to data provided by Moldovan insurance companies, about 5,300 insurance claims for damages related to accidents documented through the amicable settlement procedure were submitted in the first eight months of last year. Of these, 15% were filled in incorrectly. The files didn’t contain photographs from the scene of the accident or they didn’t fully reflect the circumstances of the accident.

The amicable settlement is a simplified and voluntary procedure for documenting an accident involving two vehicles, which resulted only in insignificant material damage the value of which does not exceed 15,000 lei. Both of the drivers must have an MTPL (compulsory third-party car liability insurance) policy. If none of the drivers admits their guilt or the material damage exceeds 15,000 lei, the accident is documented by the police.

The insurance claim is submitted by the injured party to the insurer of the guilty person, attaching the form signed by both of the parties. The amicable settlement form is issued upon request by the insurance company where the MTPL policy was purchased or can be downloaded from the NCFM’s website.

The procedure for amicable settlement of vehicle accidents was launched in September 2019. Since then and until September 2023, drivers have submitted almost 30,000 applications, of which 25,600 applications have been resolved.
