Vyacheslav Savchenko: Some of the judges become solidary in commission of abuses

A part of the judges in the Republic of Moldova commit illegalities and the judicial system therefore cannot meet citizens’ expectations. Some of the judges become solidary in the commission of abuses, jurist Vyacheslav Savchenko stated in a news conference hosted by IPN.

Vyacheslav Savchenko, who is the representative of Otilia Pintilei, her brother Nicolae Pintilei and their stepbrother, said that the three were abusively dispossessed of an apartment situated in Chisinau and were illegally deprived of the right to housing provided in accordance with the law owing also to the judges who tried the civil cases on the issue.

The jurist noted that in the 1990s, the father of Otilia Pintilei and Nicolae Pintilei was provided with an apartment to which he moved to live together with his wife and the three children. As a result of a series of events, including the annulment of the residence visa registered in that apartment, Nicolae Pintilei and Otilia Pintilei were dispossessed of the apartment.

Since 2002, they had tried to regain their right to ownership through court. But they failed to as the judges who examined the cases on the issue cooperated and mutually covered their illegalities.

In the end, the apartment was distributed to judge Lidia Bulgac, but this was yet sequestrated. In December 2003, Otilia Pintilei and Nicolae Pintilei appealed the apartment distribution decision when they learned about it. The case was distributed to judge Mihai Ciugureanu and Lidia Bulgac asked that the case be examined in her absence.

In 2008, Lidia Bulgac asked to annul the confiscation decision passed by the Centru Court in 2003, arguing the decision was already executed and she and her family moved to the apartment based on the distribution order.

Vyacheslav Savchenko said the file of the first case on the subject was fully destroyed even if it should have been preserved. The copies of the adopted court decisions, including the decision to accept the revision application filed by Nicolae Pintilei and Otilia Pintilei, could not be found at the archive of the Chisinau Court.
