The Prosecutor General’s Office (PGO) should start a criminal case against Head of Parliament Marian Lupu for exceeding his authority in the case of the December 23 incident in the Domneasca Forest, considers former security minister Anatol Plugaru, who was a member of the first Parliament and signed the Declaration of Independence. He said that under the legislation Marian Lupu was to propose for confirmation in Parliament a candidate for prosecutor general, who would have been empowered to investigate the actions of former prosecutor general Valeriu Zubco following the hunting incident, IPN reports.

Anatol Plugaru said that under the Criminal Procedure Code, the investigation of a prosecutor for the committed offenses can be launched only by a special prosecutor named by Parliament, at the suggestion of the Speaker. “Why didn’t the legislative body of Moldova name such a prosecutor on December 23 or later, when there are clear signs that former prosecutor general Zubco hid the murder. He didn’t do his duty and used his position for illegal goals? If the PGO does not start a criminal case against those to blame, I  will denounce this criminal debauchery with political-juridical cover, on my own initiative,” said the ex-minister.

He also said that the law enforcement bodies’ unwillingness to investigate the December 23 events in the Domneasca Forest, the open sabotage of the parliamentary commission of inquiry, the imitation of the investigation show that the truth about the tragedy was known from the very beginning both by the participants in the hunting and by the PGO. Thus, the investigation’s goal was to hide the truth, not to reveal it. “The actions aimed at hiding the offense and the culprits were systemic in character and weren’t reduced to such passive measures as keeping of silence, sabotage and imitation of the investigation. They were also active in character as they were aimed at destroying evidence, falsifying the list of participants in the hunting, forcing persons to make false statements, etc,.” considers the former minister. According to him, the parliamentary commission of inquiry is firmly convinced that these people behave so because they are sure they will not be held accountable for their actions.  

Anatol Plugaru believes that in order to restore the people’s confidence in the law and the authorities, Marian Lupu and Valeriu Zubco must be arrested so that they are unable to influence the investigation.

According to Plugaru, until Marian Lupu is not held accountable for abuse of power, Valeriu Zubco will not answer for his acts. The former security minister called on President Nicolae Timofti to become involved and take the investigation of this case under special control. “Do something as things cannot go on like this anymore,” he stated.

On December 23, 2012, a man was wounded fatally during the hunting in the Domneasca Forest, which involved a group of functionaries, including prosecutor general Valeriu Zubco, who was later dismissed.
