Parliament will take cognizance of Premier’s resignation, but this will not influence resignation itself

The legislative body will take cognizance of the resignation of the Prime Minister and, respectively, of the whole Cabinet, but this act will not influence the resignation itself, the process of forming the new Government and the constitutional terms inherent in this process. Such an explanation was provided by the Constitutional Court following a challenge filed by President Nicolae Timofti, IPN reports.

According to the Court’s decision, the resignation of the Prime Minister and, respectively, of the whole Cabinet takes effect when it is announced: if a written application is submitted to Parliament – when it is submitted, and if a public announcement is made – when the announcement is issued.

The President has the constitutional obligation to name an acting Premier until the new Government is formed, if the current Prime Minister can no longer hold this post. The new Government must be formed within three months, including when the Prime Minister tenders his resignation, of the moment the resignation is made public. From this date, the current Government only administers the public affairs, until a new Cabinet is sworn in.

The Constitutional Court’s decision is definitive and takes effect when it is adopted.
