A mechanism for keeping records of vulnerable lots should be instituted and special conditions on the issuance of permissive documents in the construction sector with regard to these lots should be imposed. This is one of the recommendations of a study of the authorization and execution of building works in the municipality of Chisinau that was conducted by Transparency International Moldova. The study authors recommend updating the medium-term program for working out urban design plans in localities for 2013-2016.
“The urban planning and territorial development documentation should be finalized as a result of consultations and coordination, especially of coordination, as the documents we have, according to the findings of the Court of Auditors, haven’t’ been properly coordinated with the responsible institution, at that moment the Ministry of Economy and Infrastructure. We hope the updated documentation will be approved,” study author Mariana Kalughin stated in a news conference hosted by IPN.
The study recommends supplementing the law on the principles of urban and territorial planning with provisions that would guarantee the periodical updating of urban planning and territorial development documentation, and implementing the provisions of the law on the creation and functioning of the one-stop shop for authorizing building works.
The study authors also recommend observing the normative framework on the issuance of permissive documents for building works and keeping records of permissive documents in accordance with the law, reexamining the provisions authorizing the ascertaining agent to decide whether to ask the court to demolish unauthorized constructions or not.
Mariana Kalughin urged to strengthen the capacities of the authorities involved in the process, including by appropriately treating the corruption risks identified as a result of the assessment of institutional integrity, and to assess the institutional integrity of the Agency for Monument Inspection and Restoration and the National Archeological Agency in accordance with the law.
