Mandatory medical examination instituted for judges

The judges and candidates for the post of judge will obligatorily be subject to medical examination, in accordance with an order made by the Ministry of Justice and the Ministry of Health in cooperation with the Supreme Council of Magistrates. Contacted by IPN, the head of the Resource Center for Human Rights (CReDO) Sergiu Ostaf said the order is aimed not at improving the judicial system, but at clarifying the aspects concerning medical examinations.

The state of health of judges and candidates for judge will be checked by a relevant commission that will work within the National Narcology Dispensary. It will be composed of four members and will issue the medical certificate within 10 days of the examination. The judges will take such an exam once in five years, while the candidates before the contest for filling the post of judge. The examined candidates who will not agree with the commission’s decision will be able to challenge it, but the relevant costs will be covered by them.

Sergiu Ostaf said that such orders bring clarity as regards the utilization of medical certificates. Until now the judges presented only a medical form, but now they will have to go to several more doctors.

Under the order, the diseases that are incompatible with the post of judge are: mental disorders; behavioral disorders caused by using psychoactive substances; schizophrenia; schizoaffective disorders; obsessive-compulsive disorders; dissociative disorders; personality disorders; epilepsy, and others.
