The Liberal Party appealed in the Constitutional Court some provisions of the budget and tax policy regarding the local taxes cap. The PL lawmakers say these provisions violate local autonomy rights, stripping many towns and villages in the country of their planned income, IPN reports.
According to the PL complaint, the Parliament violated the legal regulations on local autonomy. On the last day of the year, the legislative annulled in “an unilateral and abusive way” some local taxes and established maximum caps for the remaining ones. “By adopting these provisions, the Parliament deprived most of the towns, villages and communes in the country of their planned income”, argue the Liberals.
The Liberals say that the Parliament operated these amendments to the law without the mandatory assessment of their impact, considering that the local budgets had already been approved. “The law in question does not provide any compensation for losses caused as a result of the amendments and local authorities are put in a difficult position”.
Considering all of the above and the fact that the challenged law “severely affects” the principle of security of juridical rapports, the MPs request the Constitutional Court to suspend the provisions on the local tax caps until the final ruling. They also want the Court to verify the constitutionality of these amendments.
