Gennady Bîlba, an investor, says that he risks having his construction demolished based on an illegal decision issued on the basis of falsehoods and under pressure from influential people. The construction is located at 129 Spartacus St in Chisinau municipality. The investor noted that he had from the beginning all the documents needed to erect the construction, which was put into operation. Although he won the case in two lawsuits and two irrevocable decisions were passed by the Supreme Court of Justice, in another trial the court of first instance ordered the demolition of the building, while the court of appeals, in his absence, pronounced a final decision to demolish the building.

In a news conference hosted by IPN, Gennady Bîlba said that he decided to make an investment at home, in the Republic of Moldova. He bought a plot of land and, so as not to have problems with the neighbors, went and asked for their permission to build. Most of them gave their consent. Only one person refused. “Buga Elena told me she will give her consent if I bought the house of a relative of her at a triple price. It’s clear that I refused,” said the investor.

He went to the City Hall, where he was told that if he avoided the border at a distance of 2.4-3 meters, then he did not need the neighbors’ consent. So he did. He obtained the urban planning certificate and the building permit. The project was designed and the construction began. “The fact upset Mrs. Buga. She immediately began to file complaints to all the courts and I was told that I didn’t know who I got involved with. After a while, Mrs. Buga’s nephew called me and introduced himself as a prosecutor, Alexei. He told me that I won’t be able to continue the construction if I didn’t remove the balconies on her part. They summoned me to the Building Inspectorate, where I was told practically the same thing. I had to make changes in the project. Again the project was coordinated. I received another building permit and hoped that the question would be solved. But Mrs. Buga did not stop writing to all the courts and the harassment started also in courts,” stated Gennady Bîlba.

From 2018 to 2022, there were held dozens of court hearings because the woman challenged the building permit. At the Supreme Court of Justice, the applicant met with refusal. “Further, Mrs. Buga attacked me personally to stop the construction and demolish it. Again there were many court hearings. They reached the SCJ and they all denied her requests,” said the owner of the building.

In the end, the construction was completed and put into operation. Mrs. Buga did not calm down. She didn’t succeed legally, but started using another method. Having contacts in the supreme state bodies, Mrs. Buga wrote a letter to the Parliament, the Government, the Presidential Palace, the National Anticorruption Center, saying that it is an unauthorized construction. The documents were checked by the NAC, but no violation was found.

Other actions of intimidation followed. The district head’s office notified him of a letter received from the Building Inspectorate about the issuance of a report on the demolition of the building. He carried out an independent examination, but the lawsuit had been already started.  As they used falsified data, he hoped that the court would do him justice. “I suddenly noticed that it was a trial by order. Mrs. Buga and lawyer Mocanu felt at large. Buga could speak without the judge’s permission and brought the judge to account,” said the owner of the building, noting that the court decision was known in advance.
