Four judges to be investigated for illicit enrichment

The Supreme Court of Justice (SCJ) finished the examination of administrative cases regarding the annulment of the Superior Council of Magistracy’s decisions to give the go-ahead to carry out criminal investigation measures against particular judges. Thus, the court confirmed the legality of the SCM decisions, finding that they were adopted in a proportionate and reasoned manner, IPN reports.

"The appeals declared by the Superior Council of Magistracy and the Prosecutor General's Office were accepted, the decisions of the trial court were quashed and new decisions were pronounced, by which the lawsuits filed by the judges concerned were rejected as unfounded," said the SCJ.

The institution found that the court of first instance misinterpreted the applicable legal norms, applying the general provisions of the Administrative Code, without taking into account the provisions of the special legislation, namely the Law on the Superior Council of Magistracy and the Law on the Status of Judges. These normative documents expressly stipulate the powers and procedures applicable in such cases, taking precedence over the general rules.

The press wrote that the four are Alexandru Gheorghieș, former judge of the Balti Court of Appeals, Tatiana Avasiloaie, former judge, Ion Druță, ex-president of the Supreme Court of Justice, and Oleg Sternioala, former judge of the Supreme Court of Justice. The judges will be investigated for illicit enrichment.
