Experts welcome Constitutional Court’s decision on Association Agreement

The Constitutional Court took a just and wise decision when it rejected the Communist lawmakers’ challenge concerning the legality of the signing and ratification of the Association Agreement with the EU. Such statements were made in the program “Fabrika” on Publika TV channel, IPN reports.

Constitutional law expert Nicolae Osmochescu said the Constitutional Court’s decision was predictable because everything was done in accordance with the Constitution. “What the Communists did was an attempt to gain political support and they didn’t have reasons to challenge the accord in court. If the Constitutional Court took another decision, it would have violated the constitutional provisions stipulating that all the international accords and treaties represent priorities for our state,” stated the expert.

Journalist Ion Terguta considers that by this challenge the Communist Party tried to gain political support. “The PCRM is now confused. They don’t know what they want. One day they are for the Customs Union, while the next day they are for the European Union. The Court’s decision is a correct one,” he said.

Victor Juc, vice director of the Institute of Legal and Political Research of the Academy of Sciences of Moldova, said there are two explanations for the Communists’ act. “Firstly, they wanted to make use of the legal provisions allowing them to submit challenges to the Constitutional Court. Secondly, the Communists tried thus to strengthen a part of their supporters who are for the Customs Union. There is also a positive side. The Constitutional Court’s decision is an indicator of Moldova’s European course,” he stated.

The program’s permanent invitee, media analyst Cristian Tabara considers the PCRM is now in a new situation that is unfavorable to it. “They filed the challenge with the aim of gaining political support, but are now in a ridiculous situation in which they have to defend in court values that run counter to the statements they made several days ago,” he said.
