Eventis Mobile called upon the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) and the State Registration Chamber to implement the decisions of the national courts of law. The company’s lawyers told a news conference that all the legal norms concerning the fulfillment of obligations are being violated, IPN reports.
Eventis Mobile lawyer Andrei Iosip said the competent Moldovan institutions groundlessly refuse to execute the court decisions, causing thus damage both to the legal entities involved in the transactions and to the company’s creditors.
According to him, there are a number of court decisions obliging the ANRCETI to transmit the license to SRL Iulerom and the State Registration Chamber to register the contract for selling-purchasing the undivided patrimonial complex of Eventis Mobile. On June 18, 2013 the Appeals Court ruled that the Agency must transfer the license. This decision was upheld by the Supreme Court of Justice. On May 8 this year, the Chisinau Appeals Court passed a decision saying the trial must be closed as the Appeals Court already pronounced judgment. In a decision on July 15, the Appeals Court specified that the State Registration Chamber is obliged to register the aforementioned sale-purchase contract.
Andrei Iosip said there are now seven court decisions that are mandatory for all the public authorities, but these authorities illegally and groundlessly refuse to execute them. They repeatedly asked for explanations, but employees of the ANRCETI and the State Registration Chamber refused to provide answers.
“This situation makes us doubt the integrity of the administration of the ANRCETI and the State Registration Chamber. The position of the Moldovan administration is even more suspicious. The authorities every day speak about principles and values, European democracy and the observance of human rights, but they immorally promote their financial interests to the detriment of the people’s interests,” said the lawyer, adding that the Agency illegally exhibits the license of SRL Iulerom for sale.
Andrei Iosip called on the diplomatic institutions, especially the U.S. Embassy, the Embassy of Germany and the Delegation of the European Union, to take note of the demands of the creditors of Eventis Mobile and to contribute to defending the legal interests and rights of these citizens and to penalizing those to blame for the violation of these people’s rights.
The lawyer also said that ANRCETI has refused to execute the court decisions during 13 months, causing thus damage of 6.4 million lei to Eventis Mobile. If this sum is not paid by August, the company will go to court to obtain the forced collection of this sum.
