ECHR condemns Moldova in other 2 cases

The European Court for Human Rights (ECHR) has condemned the Republic of Moldova in other 2 cases - „Boicenco vs Moldova” and „Gurov vs Moldova”, both concerning the breach of human rights.
According to the ECHR decision published on the web site of the Court from Strasbourg, Nicolae Boicenco was arrested at the 20th of May 2005 by the collaborators of the Centre for Fighting Economic Crimes and Corruption (CCCEC), being suspected of fraud. Boicenco accuses that he was beaten by the employees of the mentioned centre, fact that jeopardized subsequently his health.
In the case „Boicenco vs Moldova” was certified the breach of art. nr.3 from the Europen Convention of Human Rights and, namely, exposal of a person to an inhuman, degrading treatment, the absence of an adequate medical treatment. It was also confirmed the foul of the art. nr. 5, point 1 - keeping under detention with no legal motivation.
The Republic of Moldova was obliged to pay to Nicolae Boicenco EUR 40.000 moral compensation and EUR 6.823 - expenses on judicial proceedings. Also, The Court has disposed that the Republic of Moldova would ensure an immediate and non-limited access of lawuers and doctors to Boicenco and his medical file.
In the case „Gurov vs Moldova”, the plaintiff Maria Gurov accuses the Republic of Moldova of the fact that the internal instances have determined the gain of trial to an insurance company with which she was in litigation. In this file, ECHR had deemed the state guilty for the foul of the art. nr. 6, point 1 - the right to an equitable process and has disposed the settlement of the amount of EUR 2000 for material compensations.
Up to now the Republic of Moldova was condemned at the ECHR in 36 cases, 14 of which – in 2005.
