Draft law on construction insurance did not arouse interest

Neither the general public nor the insurance and construction companies expressed interest in the draft law on construction insurance. The bill was published on the website of the Ministry of Construction and Territorial Development about one month ago, said Alexei Bosneaga, deputy head of the Ministry’s Constructions Division, Info-Prim Neo reports.
The insurances of real estate in Moldova make up less than 1% of the total insurances. The government’s efforts to support constructions owners in cases of natural calamities or other disasters are limited to the available financial resources. The bill proposed for public debates suggests a mechanism for stimulating the developing of insurance in the given sector and for supporting the construction owners with their own contribution, the contribution of the insurance companies and the support of the state, Alexei Bosneaga said.
The proposed insurance system covers all the constructions, including the realty with the status of monuments and the protection areas. State and commercial insurance companies, including foreign capital companies, which work in Moldova and have license for such a type of insurance will be involved in the process. The state will intervene only in cases of large-scale disasters.
The bill envisions the creation of the following insurance forms: [1. mandatory insurance] for new constructions, constructions under repair, constructions built from sources with increased risk, for construction-assembly works; [2. optional insurance] for the risks generated by the human imperfection in the process of designing and erecting constructions, by buying personal liability policy by architects, building site managers, construction engineers and others.
The insurance premium will be 0.35% of the insurances in rural areas and 0.30% of the insurance in urban areas. The bill also envisions the creation by insurers of a risk fund of 15% of the gross insurance payments.
The mandatory insurance includes the damage caused by natural disasters (earthquakes, landslides, floods, hurricanes, etc.), explosions and fires and the damages caused to equipment, installations and supply systems, on condition that they are used in accordance with legislative and normative documents.
The insurance activity will be supervised by the National Commission on the Financial Market and the State Main Tax Inspectorate.
