The prosecutors will soon institute criminal proceedings in order to clarify things following the conviction of Moldova by the European Court of Human Rights in the “Gemeni” case, Prosecutor General Alexandr Stoianoglo stated when being asked by journalists, IPN reports.
After the meeting of the Superior Council of Prosecutors, the chief prosecutor said that all the actions should be taken as part of criminal proceedings. Judges will be questioned and the cases, applications to the ECHR and judgments passed by the Court will be examined. It is a complex process that will be followed by decisions.
The ECHR obliged Moldova to pay €3.5 million damages in this case. The judgment was passed in 2011, but the payment order reached the Government only last month and Prime Minister Ion Chicu asked to identify a mechanism for instituting proceedings against the judges to blame for Moldova’s conviction in this case.
The Ministry of Justice requested the Prosecutor General’s Office to examine the actions of the governmental agent who didn’t file an application to review those court documents that violated plaintiffs’ fundamental rights on time. President Igor Dodon said the judges should have their property and cars confiscated and sold and the proceeds should be transferred to the state budget for paying off the damages.
