Civil Council recommends CCCEC not to take legal action on offense, but against person

The Civil Council for monitoring the work of the Center for Combating Economic Crime and Corruption (CCCEC) recommends the Center not to take legal action on offense, but against the suspect offender. In a meeting on March 26, the Council's chairman Grigore Ciocanu said most of the times these cases are closed, Info-Prim Neo reports. The Civil Council advises the CCCEC to make sure that the suspect persons are allowed to work during the examination of the cases, in accordance with the legislation. Grigore Ciocanu said the Center, in partnership with the Anticorruption Prosecutor's Office and other law enforcement bodies, should take steps to modify several articles of the Penal Code - article 55 on criminal and administrative responsibility, article 57 on freeing from criminal responsibility over contrition, and article 79 on imposing more lenient punishments than those provided by the law. “It is not right for the court to use such legal stereotypes as they do not ensure social equity. In many cases, the judges impose a more lenient sentence compared with the damage caused,” Grigore Ciocanu said. The Civil Council recommends the prosecutors to be more responsible when they examine corruption-related offenses so as to avoid their reclassification in court.
