CC sends back application concerning Shor Party for removing faults

The Constitutional Court sent back the application by which it is requested to determine the constitutionality of the Shor Party so that the faults this contains are removed, as the Court’s president Domnica Manole ordered. The reason is the Government decision hasn’t been yet published in the Official Gazette, IPN reports.

Domnica Manole ascertained that the application was filed after it was endorsed by the Government on November 9. But the document hasn’t been yet published in the Official Gazette. According to the Court, the non-publication makes the decision inexistent and the form conditions stipulated in the Constitutional Jurisdiction Code are therefore not met.

The Cabinet on Wednesday endorsed a draft decision by which the Ministry of Justice suggests determining the constitutionality of the Shor Party. According to Minister of Justice Sergiu Litvinenco, the application contains sufficient arguments showing that the party by its activities so far acted against the rule of law principles and endangers Moldova’s sovereignty and independence.

The Shor Party described the Ministry of Justice’s initiative as “one more serious abuse on the part of the PAS government.“
