CAPC anticipates technical difficulties in implementation of bill on metrology

The bill to amend the Law on Metrology can cause technical difficulties if it is passed in the current form, said the Center for the Analysis and Prevention of Corruption (CAPC) that appraised the bill, IPN reports.

In a news conference at IPN, expert Radu Jigau said the amendments proposed by the Ministry of Justice derive from Moldova’s commitment to harmonize the legislation with the community acquis. In the assessment process, there were identified no violations of the human rights, but it was established that the bill was drafted and substantiated incorrectly.

According to Radu Jigau, in the informative note the author makes no reference to the reason why the local metrology centers must be liquidated and does not specify how many such centers are there in Moldova, which is the public authority that will take over the duties of these centers and what will happen to the employees of these institutions. “Any reorganization has negative consequences, including on the personnel, and creates inconveniencies to the private individuals and legal entities that benefited from the services of the reorganized institution,” he stated.

There were also identified shortcomings as regards the terms. The bill does not specify the terms during which the National Metrology Institute must carry out the metrological assessment of the documents and issue the decision. The period for examining the documents presented by the applicants for certificates was reduced from 30 to 15 days.

Radu Jigau also said that the informative note to the bill does not contain sufficient arguments in favor of drafting such a bill, the goal pursued by implementing the new regulations, the bill’s compatibility with the corresponding regulations of the main European instruments in the filed, the economic-financial substantiation, etc.

The appraisal was carried out within the project “Harmonization of the legislation with the international human rights standards” that is supported financially by the Civil Rights Defenders of Sweden.
