Lawyer Gheorghe Macovei, alongside dwellers of an apartment building situated at 5 Decebal Blvd in Chisinau, say illegalities were committed in the process of issuing permissive documents for erecting a new nine-story block nearby and ask the local public authorities to intervene.
In a news conference at IPN, the lawyer said the block located at 5 Decebal Blvd earlier belonged to the state-run enterprise “Moldova’s Railways”. The building has an annex with several stories. At a certain stage, the annex became private property of a building company that now wants to demolish it and to construct an apartment building in its place.
The lawyer said that a number of problems related to the legality of the permissive documents were identified. A lawsuit was filed to annul the building permit and urban certificate. The Chisinau City Hall admitted a number of irregularities and initially refused to issue those documents. The General Architecture, Urbanism and Land Relations Division said an examination for demolition is needed and asked for the opinion of dwellers.
In October 2019, the permissive documents were issued, being signed by the then acting mayor without the signatures of the responsible persons of the Architecture Division. Later, a separate opinion of the Division’s representatives was included in the set of documents. These said they will not sign for demolition as the consent of the dwellers and of the condominium association is absent, invoking also other aspects.
The dwellers are concerned that the demolition of the annex will affect their apartments. The annex is connected to the block by foundation and walls. The demolition works can affect the integrity of the whole block and it is not clear who will bear responsibility for these risks and the eventual consequences.
Gheorghe Macovei noted the authorities should intervene immediately as the construction company can execute works that generate dangers to the security of the block situated near the annex. The building can partially collapse or can become fully destabilized.
