The MPs of the Party of Action and Solidarity (PAS) suggest a number of amendments to the law on the functioning of the National Integrity Authority (NIA). According to PAS MP Sergiu Litvinenco, the idea is to strengthen the role of NIA and the integrity inspector in the process of checking the property and personal interests and in the actions needed to confiscate the unjustified property, IPN reports.
It is proposed that the integrity inspector should analyze not only the incomes of the person, but also the costs incurred by this while fulfilling public duties. The person should also declare the purchased possessions, any costs incurred by him/her or the members of their families whose value exceeds six minimum salaries and also the market value of tangible or intangible assets.
Another proposal is to analyze the opportunity of verifying information received by anonymous ways. For the purpose, the denouncer needs to be protected.
National Integrity Authority president Rodica Antoci said the real market value of the declared property is one of the problems identified during the first inspections conducted by integrity inspectors. Attention should be paid to the creation of the body for strengthening the integrity inspectorate by creating the post of inspectorate chief.
Lawyer Ion Guzun noted that if the powers of NIA are extended, the extent to which the administration machinery – the Integrity Council with all its powers - is to be maintained should be discussed.
Vladislav Gribincea, chairman of the Legal Resource Center, stated that a mechanism should be instituted to prevent control over individual cases, but the integrity inspectors should obey common inspecting rules. As to the effects of the ascertaining documents on the career of persons, Vladislav Gribincea said the bill provides that the termination of work contacts or mandates will be at the discretion of employers and will not be an effect of the ascertaining documents, but he does not agree as this will undermine the authority of NIA, while the dismissal procedures will last long and the NIA’s document will be of no use.
According to the organizers of the public debate, all the recommendations will be examined.
