Alexandr Stoianoglo calls on PGO to stop illegal practices

Suspended prosecutor general Alexandr Stoianoglo made an approach to the interim administration of the Prosecutor General’s Office (PGO), asking to stop the illegal practices of persecuting public figures by investigating these for unjust enrichment. According to him, the PGO and the National Anticorruption Center during the last few years started hundreds of criminal cases and arrested tens of persons, especially public servants.

“Realizing the extremely serious danger of corruption as a social and legal phenomenon, showing full intolerance of such a behavior, I, as a jurist and as prosecutor general, even if I was suspended, consider that all those involved in the fight against corruption should comply with the legal framework in their activities. Justice cannot be done by injustice,” Alexandr Stoianoglo stated in a press briefing at IPN.

“In October 2021, when I was removed from post illegally and abusively, an avalanche of criminal cases over unjust enrichment started amid a vacuum of investigation methods, but the Prosecutor General’s Office hasn’t yet formulated instructions for investigating this category of offense for the corps of prosecutors and hasn’t oriented the prosecutors to the relevant effects of the case law of the Constitutional Court,” stated the suspended prosecutors general.

According to him, this thing led to the use of nonuniform and abusive law interpretation and application practices by prosecutors in criminal proceedings and this resulted in serious and irreparable violations of the human rights and freedoms.  

Alexandr Stoianoglo noted that he requested the acting prosecutor general, who according to the law is responsible for the penal policy in the state and for the legality of the work of the PGO, to make use of his professional duties and stop the wrongdoings and to ensure a return to normality and legality by the honest interpretation and implementation of the law.

The suspended prosecutor general said that he made similar requests to the Anticorruption Prosecutor’s Office, the Supreme Court of Justice, the Superior Council of Magistracy and the Lawyers’ Union and also informed the foreign development partners and the diplomatic corps in Moldova, noting that owing to the reduced number of prosecutors, this profession became a symbol of fear, abuse, repression, incompetence and televised handcuffing.

“I gave examples of inconsistent practices of interpreting and applying the law by prosecutors, double standards, selectivity, subjectivism and serious violations of the fundamental human rights and freedoms,” stated Alexandr Stoianoglo.
