After four years in litigation, the dwellers of an apartment building situated at 5 Decebal Blvd in Chisinau, who complained about illegalities in the process of issuing the permissive documents for erecting a new block near their home, say that they have not managed to get justice. According to them, the construction company does not comply with the requirements stipulated in the permissive document, while the authorities do not conduct inspections.

In a news conference hosted by IPN, lawyer Artur Macovei, who defends the interests of the residents of the block, said that this case is an example of how “black is white and white is black” for the authorities in the Republic of Moldova. In 2019, the Chisinau City Hall issued an urban planning certificate to a company for the construction of a residential building in the vicinity of the block located at 5 Decebal Blvd. The dwellers complain that the building is being erected too close to their block. “How do you think, after I showed clearly and obviously that the project does not correspond and the figures mathematically do not coincide, was this economic agent allowed to build? Was it issued with an authorization? I believe you can guess the answer, of course ‘yes’. Because it was noted in these explanations and answers that white is black and black is white, without an architect providing a clear assessment and calculation,’ stated the lawyer.

Artur Macovei also said that he presented in court all the conclusions and also the calculations done by a licensed architect. “The mistakes and inconsistencies in the permissive documents lead to the fact that the realities in the Republic of Moldova are getting worse. These deviations accumulate. And what do we have? When they started implementing this project and partially demolishing the access to the building, the balcony on the first floor of the building collapsed over the floor below, in July 2020. That is, all the mistakes are added up and a much more negative result than one might apparently think is obtained,” noted the lawyer.

Dweller Cristina Nucă said that she has been going through this dramatic experience for four years now, which shows her that she is not safe. “You come to a moment when a handful of people have to resist an entire state. No state institution gets involved. The responsibilities are passed from one institution to another or nothing is done at all... After four years, we saw no intervention in this situation...”, related the young woman.

According to her, in these four years she has not seen any change in the judicial system either. The judge of the Court of Appeals, who remitted the case back to the first court, is no longer in the system. “Now the court of first instance is “copying/pasting” the previous decision. “What should we, the citizens, think? So we, a handful of people, young people with children, old people fight with bulldozers - literally with the bulldozer that will come in a month and figuratively with the bulldozer of state institutions,” said Cristina Nucă.
